Maybe the problem is focus on "The roman world" and "The common law"? Why not look to a "third position" and a "royal law"? Better yet, why not look to what fulfills law, and indeed perfects equity?
Isn't the best Roman / civil / common able to achieve is to set aside law to do negative equity out of necessity? What if one can prove a higher necessity? A spiritual emergency over a commercial one? Could one then make Rome a forgotten footnote in history by filling the earth with a new mountain that destroyed all worldly kingdoms (Dan 2)?
Isn't time for a True Third Position that makes all of men's bankrupt traditions of church-state-money obsolete and irrelevant as the game of monopoly is to real life?
It should surely have reminded you of that article posted here on the ECC written by Michael Edward, the original ADMIN of this forum, in December 2004 :-)
